1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and iWorldGlobe ("we," "us," or "our"), concerning your access to and use of the iWorldGlobe application and website.

By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

Age Requirements & Parental Consent

The Service is intended for users of all ages, particularly children aged 6-13. However, if you are under 18, you represent that you have your parent or guardian's permission to use the Service. Parents/guardians are responsible for their children's use of the Service and any in-app purchases made.

2. Description of Service

iWorldGlobe is an educational geography application designed to help children explore the world through interactive 3D globes, quizzes, and games. The App provides information about countries, flags, capitals, and cultures for educational purposes.

3. User Accounts

You may use the App without creating a formal account relative to an email address. We use anonymous identifiers to track app progress (XP, badgers, etc.). You are responsible for maintaining the security of your device to protect this progress. We cannot restore data if the app is deleted and no backup (sync) mechanism was active or supported at that time.

4. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree not to:

• Use the app in any way that could damage, disable, overburden, or impair the Service.
• Attempt to gain unauthorized access to any part of the Service.
• Use any robot, spider, or other automated means to access the Service.
• Harass, abuse, or harm another person or group (though our app does not currently support direct user-to-user communication).

5. In-App Purchases & Subscriptions

iWorldGlobe offers "Pro" features which may be purchased within the App.

Prices are subject to change and may vary by region or currency.

Payment & Renewal

• Payment: Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase.
• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period.
• Management: You can verify and manage your subscription or turn off auto-renewal by going to your Account Settings on the App Store or Google Play Store after purchase.

Refunds

All purchases are processed by Apple or Google. We do not have the ability to process refunds directly. Refund requests must be made directly to Apple or Google in accordance with their refund policies.

6. Intellectual Property Rights

The App and all its content, including but not limited to 3D models, graphics, images, text, code, background music, and sound effects ("Content"), are owned by us or licensed to us and are protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational use only. You may not reproduce, distribute, modify, create derivative works of, or publicly display any Content without our prior written permission.

7. User-Generated Content

The App allows you to create a display name (nickname) and potentially select an avatar. Any "User-Generated Content" is strictly limited to these identifiers.

• No Uploads: You are not permitted to upload photos, videos, or other personal files.
• Safe Names: Display names must be appropriate for children. We reserve the right to remove or alter any display name that we deem offensive, inappropriate, or personally identifiable (e.g., real full names).

8. Disclaimers

Educational Content

iWorldGlobe is an educational tool. While we strive to provide accurate and up-to-date information about countries and geography, geopolitical boundaries and data can change properly or be disputed. The Content is provided "AS IS" and we do not warrant that all geographic data is error-free, complete, or current. This App should not be used as the sole basis for academic or navigational decisions.

Service Availability

We cannot guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

9. Limitation of Liability

To the fullest extent permitted by law, in no event will iWorldGlobe, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the service.

10. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the App or breach of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate this agreement by simply deleting the App and ceasing to use it.

12. Governing Law

These Terms shall be governed by and defined following the laws of [Your State/Country], without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved through binding arbitration or in small claims court in that jurisdiction.

13. Severability

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

14. Entire Agreement

These Terms and any policies or operating rules posted by us on the Service constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will alert you about any changes by updating the "Last Updated" date of these Terms. Your continued use of the App after the specific changes are posted constitutes your acceptance of the new Terms.
